Common questions

What's the difference between a notary and a lawyer?

A notary drafts authentic deeds (sales, wills) which carry particular legal force and are kept in the central registry, without a trial. A lawyer argues in court during disputes.

How long does a real estate transaction take?

Generally 3 to 6 weeks between an accepted purchase offer and signing, depending on financing and title verification.

Do I need a notarial will if I already made my own?

A handwritten will can be contested or lost. A notarial will is kept in the registry and doesn't need to be verified by the court after death.

Can the notary represent both parties in a transaction?

Yes, the notary is an impartial public officer, unlike a lawyer who represents a single party. This is one of the strengths of the Quebec notarial system.

What should I bring to my first appointment?

Your ID, and depending on the case: purchase offer, divorce judgment, existing marriage contract, or a list of your assets for a will.
